Last month, US District Judge William Alsup significantly escalated the stakes, ruling that the initial trio could represent every single writer of the approximately seven million books allegedly pirated by Anthropic. This decision exposes the company to a staggering potential liability of hundreds of billions of dollars, with statutory damages alone reaching up to $150,000 per infringed work.

In response, Anthropic, along with various industry groups, has urgently petitioned an appeals court to reverse the ruling. Anthropic, which recently secured billions in investment and boasts a valuation of $61.5 billion—exceeding the entire US publishing industry’s annual revenue—argues that AI is simply too vital to fail.

In its appeal petition, Anthropic describes Judge Alsup’s decision as erroneous, accusing the court of rushing to certify the class action without establishing reliable methods to identify class members or adjudicate their individual claims. The company asserts that the judge failed to conduct a “rigorous analysis,” basing his decision primarily on his five decades of judicial experience. Anthropic further warns that the immense financial risk would compel it to settle immediately, thereby denying it a fair opportunity to defend its AI model training practices in court.

This case is one of several high-profile lawsuits that carry existential implications for the AI sector. Historically, AI companies have relied on acquiring vast quantities of training data at minimal to no cost. Authors and artists, however, have increasingly sued major players like OpenAI and Meta for using their copyrighted works without permission or compensation. The industry consistently defends its data acquisition practices under the umbrella of “fair use,” arguing that being forced to pay for all copyrighted material used would effectively cripple the entire endeavor.

This stance, which often implies that the industry’s survival hinges on free access to copyrighted material, has prompted ethical questions regarding the sustainability of an industry built on ingesting virtually the entire internet. Nevertheless, tech companies have countered with arguments that the books they utilized held no independent economic value, or by invoking national security concerns, claiming that any impediment to American AI progress could leave the US vulnerable to competitors like China.

An intriguing twist in Anthropic’s appeal is its citation of precedent suggesting that copyright claims are generally poor candidates for class-action treatment. This is due to the inherent complexity of requiring each claimant to individually prove ownership of their work, a process rarely straightforward in the fragmented world of publishing rights. Surprisingly, some prominent author advocacy groups, including the Authors Alliance and the Electronic Frontier Foundation, appear to concur with Anthropic on this specific procedural point. In a brief, these groups argued that the court’s decision to expand the suit “lazily lumped” seven million books into a single category, making an unfounded assumption that all involved parties would share common interests.

The Authors Alliance stated that the court conducted no analysis into the types of books included, their authors, applicable licenses, or the diverse interests of rightsholders. This highlights a potential divergence of opinion even among authors and their publishers regarding AI. Furthermore, the decision did not adequately address the complexities arising from deceased authors whose literary estates often have rights split across multiple parties.
